1. Acceptance of Terms

By registering with, accessing, or using this website (hereinafter referred to as “BidBroz Liquidation Limited” -“we” or ‘BidBroz’), you confirm that you have read, understood, and agree to be bound by the following Terms and Conditions, including all policies, rules, and regulations set forth on this site. If you do not agree to these terms, do not use this website. These Terms and Conditions may be updated from time to time, and you are advised to review them periodically.

2. Registration and Account Information

(a) Eligibility: You must be at least 18 years of age to register on BidBroz Liquidation Limited’s website. By registering, you confirm that you meet the eligibility requirements.

(b) Accuracy of Information: You agree to provide truthful, accurate, and complete information during registration and throughout your use of this website. You are responsible for updating your registration details to ensure they remain accurate.

(c) Account Security: You are responsible for maintaining the confidentiality of your account and password and for all activities under your account. If you suspect any unauthorized use of your account, you must notify us immediately.

(d) No Responsibility for User Violations: BidBroz Liquidation Limited is not responsible for any damages, losses, or legal consequences resulting from violations of these Terms and Conditions or misuse of the platform by users under their account. You agree to indemnify and hold BidBroz harmless from any claims, losses, or damages arising from such activity.

3. Bidding and Purchasing

(a) Legally Binding Contract: By placing a bid, you agree to enter into a legally binding contract with BidBroz Liquidation Limited to purchase the item if you are the highest bidder at the close of the auction.

(b) Buyer’s Premium and Taxes: All bids are subject to an 8% buyer’s premium, which will be added to the winning bid. Additionally, applicable taxes (13% HST) will be charged on the total purchase price.

(c) Payment Methods: We accept payment via cash, debit, credit card (Visa, Mastercard), or e-transfer. Prepaid credit cards and e-checks are not accepted. Payments must be made in full before pickup.

(d) Payment Deadline: All items must be paid for and collected by the stated deadline. Failure to do so will result in penalties and possible forfeiture of the items.

4. Pickup and Storage

(a) Full Payment Required: You must pay for all won items in full online or at the time of pickup in person. Partial payments or pick-ups are not permitted.

(b) Late Pickup Fee: If items are not collected by the deadline, a 15% storage fee will be added to the total invoice. If an unpaid invoice is not collected, the items will be forfeited, and your account will be suspended.

(c) Forfeiture and Suspension: If you fail to pick up paid items by the deadline, the items will be forfeited, and your account will be suspended. Refunds will be issued minus a 15% storage fee. Accounts with three missed payments or pickups will be permanently banned.

5. Cancellations and Account Termination

(a) Right to Cancel Bids or Auctions: BidBroz Liquidation Limited reserves the right to cancel, refuse, disqualify, or modify any bid, auction item, or account at its discretion, with or without cause.

(b) Suspension or Termination: We may suspend or terminate your account for failure to comply with these terms, including repeated missed payments, pickups, or any other violation. Terminated accounts will be permanently banned from the site.

6. Warranty and Returns

(a) In-House Warranty: Unless otherwise stated, all items come with an in-house warranty against defects that were not stated in the product description .

(b) AS-IS Items: Items marked “AS-IS” come with no warranty and are not eligible for returns or refunds.

(c) Inspection and Return Policy: Buyers are encouraged to inspect all items during pickup. items cannot be returned for reasons such as buyer’s regret or misjudgment on value.

(d) Mislisted or Damaged Items: If an item malfunctions or is mislisted, and were not stated in the product description . it is the buyer’s responsibility to notify BidBroz Liquidation Limited immediately before warranty dead line. We are not liable for issues discovered after warranty dead line 

7. Payment Disputes and Collection

(a) Disputes: Any payment disputes may be resolved through legal means, including the engagement of a collection agency.

(b) Waiver of Jury Trial: By participating in auctions or using this website, you waive the right to trial by jury in any legal disputes related to BidBroz Liquidation Limited.

8. Product Recalls and Safety

It is the buyer’s responsibility to check for product recalls or safety hazards. Buyers should familiarize themselves with the Canada Consumer Product Safety Act regarding their purchased items.

9. Copyright and Intellectual Property

(a) All content on this website, including text, graphics, logos, images, and software, is the exclusive property of BidBroz Liquidation Limited and is protected by copyright laws.

(b) Unauthorized reproduction, redistribution, or modification of any content on this site is prohibited.

10. Taxes

Taxes will be applied to all items purchased according to Ontario and Canadian provincial tax laws. It is the buyer’s responsibility to ensure tax compliance.

11. Changes to Terms

(a) Modification of Terms: BidBroz Liquidation Limited reserves the right to alter, amend, or update these Terms and Conditions at any time. You are responsible for reviewing them regularly to stay informed of any changes.

(b) Enforceability: If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

12. Limitations of Liability

(a) No Liability for External Content: BidBroz Liquidation Limited is not responsible for the accuracy or content of third-party websites or information linked to from this website.

(b) Limitation of Liability: To the fullest extent permitted by law, BidBroz Liquidation Limited shall not be liable for any indirect, incidental, or consequential damages resulting from your use of this website or participation in any auction.

13. Disclaimer of Liability for Product Failure or Misuse

(a) No Liability for Product Failure: BidBroz Liquidation Limited (hereinafter referred to as “BidBroz”) shall not be held liable for any defects, malfunctions defects, failures, or damages arising from products sold or given away through our platform. By participating in auctions or accepting items from BidBroz, you acknowledge that you are purchasing or receiving these products at your own risk and that BidBroz does not warrant or guarantee the condition, functionality, or safety of any item once it has been sold, transferred, or taken possession of by the buyer.

(b) No Responsibility for Misuse or Improper Handling: BidBroz assumes no responsibility for the misuse, improper handling, or incorrect installation of any products purchased. The buyer is solely responsible for ensuring that products are used, handled, and maintained in accordance with the manufacturer’s instructions and safety guidelines. BidBroz shall not be liable for any damage or injury resulting from such misuse or improper handling.

(c) No Warranty on “AS-IS” Items: All “AS-IS” items, whether sold or given away, are provided with no warranty, express or implied, and BidBroz expressly disclaims any liability for the condition or performance of these items. All “AS-IS” items are sold in their current state, and BidBroz will not be responsible for any issues arising after the item’s transfer to the buyer.

(d) No Responsibility for Recalls or Safety Hazards: BidBroz does not accept any liability for product recalls or safety hazards related to any items sold or distributed. It is the buyer’s responsibility to stay informed of any recalls or safety notices associated with any purchased products. Buyers are encouraged to check relevant government and regulatory websites to ensure the safety of products post-purchase.

(e) Limitation of Liability: Under no circumstances shall BidBroz be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use, failure, or misuse of any product, regardless of whether BidBroz was advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profit, business interruption, or any other commercial or personal losses.

14. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, Canada. Any legal action or proceeding arising out of or related to these terms shall be exclusively filed in the courts located in Ontario.

15. General Provisions

(a) Force Majeure: BidBroz Liquidation Limited will not be held liable for any failure to perform due to events beyond its reasonable control, including but not limited to natural disasters, labor disputes, or technical failures.

(b) Entire Agreement: These Terms and Conditions, along with any additional policies and rules, constitute the entire agreement between you and BidBroz Liquidation Limited regarding your use of the website.
